Usage agreement for photographs

If EUROHUNT provides the DISTRIBUTION PARTNER with photographs, the following provisions apply, unless a deviating written agreement has been concluded in the isolated case:

      I.    The parties assume that the photographs are protected by copyright in favor of EUROHUNT. The DISTRIBUTION PARTNER acknowledges the copyright usage rights of EUROHUNT.
      II.   Upon request by EUROHUNT, the DISTRIBUTION PARTNER will add a copyright notice identifying the photographer named by EUROHUNT as the author and/or a notice that clarifies EUROHUNT’s position as the licensor.
      III.  The granting of usage rights is purpose-specific. The photographs may only be used for the articles purchased by EUROHUNT and for which EUROHUNT has given consent for usage. Consent must be obtained in writing (an email is sufficient in this case) before usage begins. The consent may be limited to a specific period or to a particular edition of a sales catalog or other medium.
      IV.   The DISTRIBUTOR is not authorized, without prior written (an email is sufficient in this case) consent from EUROHUNT, to use the photograph only in part and/or to alter it. Necessary modifications for usage (e.g., formatting, size changes, etc.) are permitted.
      V.    All granted usage rights are non-exclusive. This means that EUROHUNT remains entitled to use the photographs itself and may also grant third parties the right to use them.
      VI.   The granted usage rights are tied to the DISTRIBUTION PARTNER and cannot be transferred without prior explicit written (an email is sufficient in this case) consent from EUROHUNT. The DISTRIBUTOR is not authorized to grant sublicenses without prior explicit written (an email is sufficient in this case) consent from EUROHUNT. The DISTRIBUTION PARTNER may not make EUROHUNT’s photographs available to third parties.
      VII.  EUROHUNT may at any time request a list from the DISTRIBUTION PARTNER detailing which photographs of EUROHUNT he has used for which purposes, as well as to whom and for which photographs and purposes he has granted sublicenses (if EUROHUNT has granted consent for sublicensing). The DISTRIBUTION PARTNER must, upon request, confirm the accuracy of the list. The right to use photographs not listed in the list automatically expires.
      VIII. Consent for usage may be revoked by EUROHUNT at any time. Upon revocation, the right to use the photographs ends.
      IX.   The right to use the photographs ends automatically at the latest upon the termination of the business relationship.
      X.    In the event that the right to use the photographs ends due to revocation or termination of the business relationship, EUROHUNT will offer a reasonable usage phasing-out arrangement. This does not apply if the revocation or termination of the business relationship is due to reasons within the DISTRIBUTION PARTNER’s sphere or if a phasing-out arrangement is not reasonable for EUROHUNT for other reasons. A phasing-out arrangement may, at EUROHUNT’s discretion, also be carried out by taking over promotional materials in exchange for compensation.
