Usage agreement for photographs

If EUROHUNT provides the DISTRIBUTION PARTNER with photographs, the following provisions apply, unless a deviating written agreement has been concluded in the isolated case:

  1. The DISTRIBUTION PARTNER recognises EUROHUNT’s rights under copyright law.
  2. At the request of EUROHUNT, the DISTRIBUTION PARTNER will provide a copyright notice making clear the legal ownership of EUROHUNT.
  3. The surrender of use takes place on a purposive basis. The photographs may be used exclusively for the articles purchased atEUROHUNT and the use of which has been approved by EUROHUNT. The approval must be obtained before the commencementof use. The approval can be restricted to a specific time period or a specific issue of a sales catalogue or another medium.
  4. The processing of photographs also requires the prior approval of EUROHUNT.
  5. All surrendering of use takes place on a non-exclusive basis. This means that EUROHUNT itself remains authorised to use theobject and may also surrender use to third parties.
  6. The surrender of use is bound to the DISTRIBUTION PARTNER and is not transferable. The DISTRIBUTION PARTNER shall not havethe right to make photographs of EUROHUNT available to third parties.
  7. EUROHUNT has the right to demand at any time that the DISTRIBUTION PARTNER supply it with a list of the photographs ofEUROHUNT it uses and for which purposes. The DISTRIBUTION PARTNER shall ensure the accuracy of the list upon request. Au-thorisation to use photographs that are not mentioned in the list ceases automatically.
  8. The approval for use can be withdrawn by EUROHUNT at any time. With the withdrawal, the right of use ends.
  9. The right of use ends automatically with any termination of the business relationship.
  10. Should the right of use end due to withdrawal or termination of the business relationship, a reasonable exhaustion regulationshall be offered by EUROHUNT. This does not apply if the withdrawal or the termination of the business relationship is based ongrounds in the sphere of the DISTRIBUTION PARTNER or an exhaustion regulation is not reasonable for EUROHUNT for other rea-sons. EUROHUNT may also elect to implement an exhaustion regulation through the assumption of advertising media against compensation.
